Textualism and the Indian Canons of Statutory Construction

When interpreting statutes enacted for the benefit or regulation of Indians construing treaties signed with Indian nations, courts are supposed to apply any five specific canons construction relating Affairs. Through examining modern line Supreme Court cases involving statutory treaty interpretation this Article demonstrates that has generally been faithful in applying abrogation. The also respected canon requiring unequivocal expression congressional intent before finding an abrogation tribal sovereign immunity. However, there two other almost never applies. One, sovereignty canon, requires clear interfere rights; other, ambiguity be construed liberally ambiguities resolved Indians. After reviewing possible reasons why textualist jurists might opposed use substantive canons, makes arguments remedy reluctance using and canons. First, these have constitutional roots, as such, even textualists on should not reluctant them. Second, more established concerning immunity extend interfering rights. There no normative treat differently than interference sovereignty.
